Discrimination


Discrimination is a benign word that means to distinguish or observe a difference. But any legal philosophy of discrimination between classes of people must be formed in the context of purpose or reason, bias, and individual merit. If there is a very good reason or purpose to discriminate, and there is no preconceived bias in favor of or against a class of people, then discrimination is usually not a legal problem.

Skin color describes several classes of people and has virtually no bearing on anything so there is usually no reason for anyone to discriminate against one's skin color any more than the color of one's eyes. This is why racial diversity in marriage was such a wonderful thing. It was a breakthrough against same-race orientation. If a job position or institution, etc., does not have a good purpose or reason for discrimination or there is a reason NOT to allow discrimination, but discrimination still exists, then discrimination becomes illegal discrimination.

dis·crim·i·nate: To show preference (bias) on the basis of class (sex, race…), not by individual merit.

prej·u·dice:  A preconceived preference or orientation or favoritism...

Racism: “I’m white and I have an orientation for whites above blacks”

Sexism: “I’m male and I have an orientation for men above women" (a.k.a. homosexuality)

Any public, government or tax-payer support of illegal discrimination is prohibited by the US constitution. If there is a reason or purpose for discrimination such as the need to discriminate gender or race in order to form a same-sex women's or men's club or same-race cultural club then discrimination is tolerated, but the club would not be able to directly receive government benefits.

In contrast, there is a huge purpose to include the two complimentary and uniquely qualified genders in a marriage union of one man & one woman. In fact, procreation and the family unit could be called the greatest purpose in all of nature and society. Society cannot survive without men and women and the family. Heterosexuality is absolutely NECESSARY. In contrast, society CAN obviously survive without same-sex unions. This does not mean that we should treat homosexual people without dignity. We should love them and help them to understand the negative impact of their sexist orientation just like we would help a genetic obese person or alcoholic to understand that obesity and alcoholism are not healthy for them or for society.

Favoritism is also a form of discrimination. One meaning of favoritism is that an unqualified person is chosen or benefited above a fully qualified person because of unfair preference for the unqualified person.

Therefore, if tax-payer benefits are not allowed to go directly to a same-sex women's club, then why should civil benefits go to same-sex marriages or civil unions which are essentially same-sex clubs of two? Furthermore, what would the purpose be to enable two same-sex people, who are unqualified by nature to have a family, the ability to discriminate against the fully qualified complimentary gender in order to get government benefits, while the complimentary gender is used as a second-class donor-concubine and gets nothing? Any kind of same-race or same-sex orientation that does not consider a person's individual merit is discrimination. Homosexuality segregates men and women without any regard for individual merit, possibly by mindless genetic orientation. Are we to believe that same-sex gender discrimination is a role model for romantic love?

Most jobs or institutions have a clear need for certain individual qualifications. In these cases discrimination is legal and beneficial in order to select that one qualified person according to their individual merit. The government will allow benefits in these cases. This is also true for civil-marriage and many other institutions. Only qualified gender-diverse people are allowed to marry. Discrimination is also a good thing when electing a qualified president or government official! This is called discrimination based on individual merit.
